Overview
Establishes the Divine Nine Special Plate and Fund. Outlines background and font requirements for all license plates. Replaces a $850,000 appropriation to the Maricopa Association of Governments for a Sun City transportation project study with an $850,000 appropriation to the Arizona Department of Transportation (ADOT) for a Sun City rapid transit system study. Outlines requirements for the Sun City rapid transit system study.
History
The Arizona Department of Transportation (ADOT) is required to provide every vehicle owner one license plate for every vehicle registered upon application and payment of fees (A.R.S. § 28-2351). Special plates may be issued by ADOT in the place of regular plates, upon application (A.R.S. § 28-2403). An initial and annual renewal fee of $25 is required for the special plate in addition to the vehicle registration fees. Of the $25 special plate fee, $8 is an administrative fee and $17 is an annual donation to a specified organization (A.R.S. § 28-2402). Special plates are established through statutory authority and require a standard $32,000 implementation fee from a person.
Provisions
1. Outlines background color and font requirements for all license plates designed or redesigned on or after September 24th, 2022. (Sec. 1)
2. Establishes the Divine Nine Special Plate and Fund if a person pays the $32,000 implementation fee to ADOT by December 31st, 2023. (Sec. 4)
3. Requires the person who provides the $32,000 implementation fee to design the Divine Nine Special Plate. (Sec. 4)
4. Allows ADOT to combine requests for the Divine Nine Special Plate with requests for personalized special plates and subjects the request to additional fees. (Sec. 4)
5. Stipulates that of the $25 fee for the original plate and renewal, $8 is a special plate administration fee and $17 is an annual donation. (Sec. 4)
6. Requires ADOT to deposit all special plate administration fees into the state Highway Fund and all donations collected into the Divine Nine Special Plate Fund. (Sec. 4)
7. Directs ADOT to allocate monies from the Divine Nine Special Plate Fund to an organization that paid the implementation fee and was founded in 2018 that has the mission to:
a) Foster cooperative actions of its members in dealing with matters of mutual concern;
b) Promote the well-being of its affiliate sororities and fraternities;
c) Facilitates the establishment and development of local councils;
d) Provides leadership training for its constituents; and
e) Educates citizens and communities in this state in the interest of the general public through community education, literature and broadcast information with respect to government issues about methodologies and strategies to improve, maintain and promote the needs and knowledge of residents in this state, with respect to economic development, public safety and access to educational opportunities so that the residents of this state can serve for the protection, conservation and preservation of their human and natural environment in and around this state. (Sec. 4)
8. States that upon notice from the director of ADOT, the state treasurer is to invest and divest monies in the Divine Nine Special Plate Fund, all monies earned from the investment must be credited to the Fund. (Sec. 4)
9. Stipulates that the name of an authorized Divine Nine sorority or fraternity may be displayed along the bottom of the Special Plate as approved by ADOT. (Sec. 4)
10. Modifies Laws 2023, Chapter 133 by removing a FY 2024 appropriation of $850,000 from the State General Fund (GF) to the State Treasurer for distribution to the Maricopa Association of Governments for a Sun City transportation project study. (Sec. 8)
11. Appropriates $850,000 from the GF in FY 2024 to ADOT to contract with a third party to conduct a Sun City solar-powered personal rapid transit system study (study). (Sec. 10)
12. Exempts the Appropriation from lapsing. (Sec. 10)
13. Requires the third party to consist of:
a) People who have successfully designed and implemented a personalized public transit system and whose skills, either directly or through limited subcontracting, cover the technical areas of solar power, electrical, mechanical, software, systems, test and safety engineering for scope of the committee; and
b) People who have successfully managed companies, who have direct experience designing and planning large-scale projects greater than $250,000 and who have direct experience building projects of the anticipated scale and cost of a solar-powered personal rapid transit system in Sun City. (Sec. 9)
14. Directs the study to:
a) Include a survey the Sun City community and relevant people within the community and local government agencies and develop a clear set of needs of the community and the agencies;
b) Include a design for a solar-powered personal rapid transit system in Sun City that consists of small driverless vehicles traveling on an elevated guideway providing on-demand, origin-to-destination travel between accessible offline stations. All transit power from the system must be derived from solar power. The design is required to be funded by private persons or by public-private partnerships; and
c) State how its finding for the Sun City community apply to other cites, towns and counites in this state. (Sec. 9)
15. Makes technical and conforming changes. (Sec. 1-3, 5-8)
