Purpose
Background
In a county
with a population of 400,000 persons or fewer (rural county): 1) the county
board of supervisors must receive petitions signed by real property owners to
form a rural planning area; 2) cities and towns and the county sharing a
multijurisdictional area may be authorized to form rural planning zones to
develop coordinated and comprehensive regional plans; and 3) the officer
collecting transportation excise tax monies must immediately transfer the
monies to the State Treasurer for deposit in the county's regional area road
fund. For each rural county that does not contract with the Arizona Health Care
Cost Containment System (AHCCCS) to provide services under ALTCS, the Director
of AHCCCS must issue a request for proposal every five years for a program
contractor to provide services to eligible members. A county with a population
of more than 400,000 persons must operate and administer a voluntary diesel
emissions retrofit program for the purpose of reducing particulate emissions
from diesel equipment (A.R.S.
§§ 11-806;
28-6391;
36-2944;
and 49-474.07).
According to the 2020 U.S. decennial census, the population of Pinal County is estimated to be 425,264 persons (U.S. Census Bureau).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Increases, from 400,000 to 500,000 persons, the population threshold under which a county is subject to prescribed requirements relating to rural planning areas, transportation excise tax distribution and ATLCS contractors.
2. Increases, from 400,000 to 500,000 persons, the population threshold over which a county must operate a voluntary diesel emissions retrofit program.
3. Makes technical and conforming changes.
4. Becomes effective on the general effective date.
