Purpose
Requires, for a restriction on highway use to be enforceable, signs to be placed at least every quarter mile, inform the public of the restriction and direct the public to the fastest route to leave the restricted route.
Background
A local authority may prohibit, by ordinance or resolution, the operation of trucks or other commercial vehicles or impose limitations on the weight of vehicles on highways under its jurisdiction. The local authority must place appropriate signs on the highway to designate a prohibition or limitation.
The Director of
the Arizona Department of Transportation (ADOT) may determine by resolution or
impose restrictions on the weight of vehicles on highways under the
jurisdiction of the Director of ADOT (Director). A restriction is effective
once signs giving notice of the restriction are erected on the portion of the
highway affected by the resolution (A.R.S.
§ 28-1106).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires signs giving notice of highway usage restrictions to:
a) be placed at least every one-quarter mile along the designated highway;
b) inform the public of the restriction; and
c) direct the public to the fastest route to leave a restricted route.
2. Deems a restriction on highway usage as unenforceable if the Director or local authority fails to erect and maintain signs, as prescribed.
3. Becomes effective on the general effective date.
