Purpose
Prohibits the county board of supervisors (county BOS) or other officer in charge of elections from authorizing, establishing or using a voting center and allows only the use of polling places located in election districts.
Background
Statute outlines the authorization, establishment and use of voting centers and emergency voting centers. A county BOS must establish a convenient number of election precincts in the county and define the boundaries of the precincts. A county BOS, on a specific resolution, may authorize the use of voting centers in place of, or in addition to, specifically designated polling places. A voting center must allow any voter in the county to receive the appropriate ballot for the voter on election day after presenting identification. A county BOS may pass a resolution authorizing the county recorder or other officer in charge of elections to establish emergency voting centers (A.R.S. § 16-411).

The resolution must specify the location and hours of operation of emergency voting centers (A.R.S. § 16-411). As a result of an emergency between 5:00 p.m. on the Friday preceding an election and 5:00 p.m. on the Monday preceding an election, an elector may request to vote at an emergency voting center established by the county BOS. Before voting, an elector who experiences an emergency must provide identification and sign a statement under penalty of perjury that states the person is experiencing or experienced an emergency after 5:00 p.m. on the Friday preceding an election and before 5:00 p.m. on the Monday preceding the election that would prevent the person from voting at the polls. An emergency is any unforeseen circumstances that would prevent the elector from voting at the polls (A.R.S. § 16-542).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
2. Allows only the use of polling places located in election districts.
3. Repeals the statutes relating to voting centers and emergency voting centers.
4. Makes technical and conforming changes.
5. Becomes effective on the general effective date.
