Purpose

Prohibits a person from paying or receiving anything of value based on the number of voter registrations or voter registration forms collected, completed or submitted.

Background

Federal, state, county and local government agencies, political parties and private organizations that conduct voter registration activities are provided, at no cost: 1) state voter registration forms by the county recorder; and 2) federal voter registration forms by the Secretary of State (SOS) (A.R.S. § 16-151). The SOS and county recorders may place restrictions on the number of registration forms that the SOS and county recorder provides to individuals or organizations depending on the type of registration activity (EPM Ch. 1 (I)(A)).

To be eligible to vote in Arizona the registrant must be a citizen of the United States (A.R.S. § 16-101). A person is presumed to be properly registered to vote on completion of a registration form that contains certain identifying information and a checkmark or other appropriate indicator that the person answered "yes" to the citizenship question. Any application that does not include the information required to be on the registration form and any application that is not signed is incomplete (A.R.S. § 16-121.01).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Prohibits a person from paying or receiving money or any other thing of value based on the number of voter registrations or voter registration forms collected, completed or submitted.

2.   Becomes effective on the general effective date.

Governor's Veto Message

The Governor indicates in her veto message that she does not believe that S.B. 1180 is the right solution to the challenges facing Arizona elections.
