eyelash technicians; registration

Purpose

Establishes an eyelash technician registration under the regulatory authority of the Arizona Barbering and Cosmetology Board (Board). Outlines eyelash technician registration and regulatory requirements.

Background

The seven-member Board enforces sanitary and safety requirements for salons and schools and for the practice of cosmetology, aesthetics, nail technology and hairstyling. The duties of the Board include issuing licenses, administering and grading practical and written examinations and prescribing the minimal school curriculum requirements for cosmetologists, aestheticians, nail technicians, hairstylists and school instructors (A.R.S. §§ 32-502 and 32-504). Statute defines the practice of aesthetics and cosmetology as including arching eyebrows or tinting eyebrows and eyelashes (A.R.S. § 32-501).

The qualifications for a cosmetologist license include: 1) that the person must be at least 18 years old or 16 years old and have completed at least two years of high school education or its equivalent; 2) evidence that the person is a graduate of a cosmetology course consisting of at least 1,500 hours of training in a Board-licensed school, a graduate of a cosmetology school in another state or country with substantially the same requirements as Arizona or that the person completed a U.S. Department of Labor-approved or a Department of Economic Security (DES)-approved apprenticeship program in cosmetology that includes at least 250 hours of infection protection and law review instruction through either a Board-licensed school or a school or program with substantially equivalent licensure requirements or a DES-approved apprenticeship program; and 3) passing the licensing examination (A.R.S. § 32-511).

The qualifications for an aesthetician license include: 1) that the person must be at least 18 years old or 16 years old and have completed at least two years of high school education or its equivalent; 2) evidence that the person is a graduate of an aesthetician course consisting of at least 600 hours of training in a Board-licensed school or the person is a graduate of a school in another state or country with substantially equivalent requirements to Arizona and; 3) passing the licensing examination (A.R.S. § 32-510).

If the collection of eyelash technician registration and renewal fees changes Board revenues, there may be a fiscal impact to the state General Fund.

Provisions

1. Establishes an eyelash technician registration under the regulatory authority of the Board.

2. Requires an eyelash technician to be registered by the Board.

3.   Entitles a person to receive an eyelash technician registration if the person:

a)   submits to the Board an application for an eyelash technician registration on a form supplied by the Board;

b)   either:

i. completes and receives appropriate credits for at least two years of high school education or its equivalent as prescribed by the Board in its rules and submits satisfactory evidence that the person is at least 16 years old; or

ii. submits to the Board satisfactory evidence that the person is at least 18 years old;

c)   submits to the Board satisfactory evidence that the person successfully completed at least 30 hours of training through a Board-approved training program that provides a provisional registration to the person verifying the successful completion of the training; and

d)   pays the prescribed fees.

4.   Requires an eyelash technician to submit an application and prescribed fees for renewal of the person's registration on or before the person's birthday once every two years.

5.   Requires an eyelash technician to also pay the prescribed delinquent renewal penalty if the person fails to renew the registration on or before the person's birthday.

6.   Requires the Board to maintain a current register of registered eyelash technicians who are in good standing with the Board.

7.   Requires the Board to establish and collect fees for eyelash technician registration, renewal and delinquent renewal in amounts to be determined by the Board.

8.   Applies the unlawful acts and disciplinary action statutes to eyelash technician registrants.

9.   Removes a person who applies eyelash enhancements from the individuals who are exempt from the statutes governing cosmetology.

10.  Excludes, from the definition of aesthetician, an eyelash technician.

11.  Excludes, from the definition of cosmetology, performing personal services related to eyelash extensions.

12.  Defines eyelash technician as a person who is not licensed as a cosmetologist or aesthetician and who, for compensation, performs personal services limited to eyelash extensions.

13.  Defines eyelash extensions as applying, removing and trimming threadlike natural or synthetic fibers to an eyelash, including cleansing the eye area and lashes.

14.  Excludes, from the definition of eyelash extensions, the application of eyelash enhancements that are tattoos, color agents, straightening agents, permanent wave solutions or bleaching agents to the eyebrow or any other cosmetology service.

15.  Makes technical and conforming changes.

16.  Becomes effective on the general effective date.
