Purpose

Modifies information required to be included in the annual report of the Arizona State Board of Dental Examiners (BODEX) and requires BODEX to post the report on its public website.

Background

BODEX is the regulatory body that oversees the licensing and practice of dental care in Arizona. BODEX's duties include: 1) adopting and enforcing rules to regulate the practice of dentists, supervised personal and registered business entities; 2) maintaining a record of BODEX's acts and proceedings, including issuance, denial, renewal and suspension of licenses and complaints; 3) establishing a standard of educational requirements that are consistent with the American Dental Association Commission on Dental Accreditation and the U.S. Department of Education; 4) determining the reputability of dental, dental therapy and dental hygiene schools;
5) issuing licenses and restricted permits to eligible persons; 6) investigating misconduct charges of licensees and those with restricted permits; 7) issuing disciplinary action against licensees, certificate holders and restricted permittees; 8) establishing criteria for the renewal of permits relating to general anesthesia and sedation; and 9) any other duties necessary to enforce the regulation of the dental profession (A.R.S. § 32-1210).

BODEX is required to make an annual written report to the Governor for the preceding year, no later than October 1, that includes: 1) the number of licensed dentists in Arizona; 2) the number of licenses issued during the preceding year and to whom issued; 3) the number and date of examinations held; 4) the facts and results from hearings of filed accusations; 5) the facts with respect to prosecution of persons charged with violations; 6) a full and complete statement of financial transactions of BODEX; and 7) any matters BODEX wishes to include or the Governor requires. The Governor may additionally request a supplemental report (A.R.S. § 32-1207).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Requires BODEX to post its annual written report on the BODEX public website.

2.   Requires BODEX's annual report to reflect the preceding fiscal year, rather than calendar year.

3.   Requires the annual written report to additionally include the number of licensed dental therapists and hygienists, certified denturists and registered businesses in Arizona.

4.   Expands the requirement that the annual report include the number of licenses issued in the preceding year to also include the number of issued certificates and registrations.

5.   Removes the requirement that the annual report outline to whom licenses were issued.

6.   Removes the requirement the annual report include the number of examinations held and the dates of the examinations.

7.   Requires the annual report to include the outcomes of any filed complaints, rather than facts regarding accusations.

8.   Removes the requirement that information provided in the report relating to violators of dental statutes also include information relating to a violator's prosecution.

9.   Makes technical changes.

10.  Becomes effective on the general effective date.
