ARIZONA STATE SENATE
Fifty-Sixth Legislature, First Regular Session
vehicle mileage; tracking; tax; prohibitions
Purpose
Establishes prohibitions on considering vehicle miles of travel in transportation or land use planning, recording a person's vehicle miles of travel and imposing a fee or tax based on vehicle miles of travel.
Background
A travel reduction plan is a written report outlining travel reduction measures. Vehicle miles traveled is the number of miles traveled by a motor vehicle for commute trips. A mile traveled by a reduced emission vehicle is counted as less than a full vehicle mile traveled for travel reduction plan purposes (A.R.S. § 49-581).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Prohibits the state or a city, town, county or political subdivision of the state from considering or establishing any vehicle miles of travel reduction goals or targets in developing any transportation or land-use planning or selecting transportation or transit projects.
2. Prohibits the state or a city, town, county or political subdivision of the state from tracking or maintaining a record of a person's vehicle miles of travel by recording the odometer reading through the use of traffic or other cameras or using third-party data or any other means that would allow an agency of the state to know how many vehicle miles a person has traveled.
3. Prohibits the state or a city, town, county or political subdivision of the state from imposing or collecting any mileage fee or tax, a per-mile charge, fee or tax or any tax or fee based on vehicle miles traveled by an individual in a motor vehicle.
4. Becomes effective on the general effective date.
