mobile homes; certificates of title

Purpose

Establishes a separate application process for the certificate of title to a mobile home, including an application for the transfer of a mobile home certificate of title and a certificate of title to a new or used mobile home.

Background

A person must apply to the Arizona Department of Transportation (ADOT) for a certificate of title to a motor vehicle, trailer or semitrailer within 15 days after the purchase or transfer of the vehicle, trailer or semitrailer on a form prescribed or authorized by ADOT and may be required to complete a vision screening test prescribed by ADOT (A.R.S. § 28-2051).

A mobile home is a structure that is transportable in one or more sections, including the plumbing, heating, air conditioning and electrical systems that are contained in the structure, and that, when erected on site, is either: 1) more than 8 body feet in width, 32 body feet or more in length and built on a permanent chassis; or 2) regardless of the size, used as a single family dwelling or for commercial purposes with or without a permanent foundation (A.R.S. § 28-2001).

The Joint Legislative Budget Committee fiscal note estimates that S.B. 1472 could cost ADOT several hundreds of thousands of dollars on a one-time basis for the change in administrative procedures and some ongoing administrative costs in providing mobile home title information to county assessors (JLBC Fiscal Note).

Provisions

1.   Requires a person to apply to ADOT on a form prescribed or authorized by ADOT for a certificate of title to a mobile home within 30 days after the purchase or transfer of the mobile home.

2.   Requires the application to contain:

a)   the vehicle identification number, name of the manufacturer and width, length, model, body style and year of the mobile home;

b)   information regarding any liens on the mobile home;

c)   the transferee's complete residential address, full name and either the driver license number of the transferee or a number assigned by ADOT;

d)   the physical location of the mobile home, date of sale and total sale payment amount;

e)   identification of whether the transferor and transferee are related and whether the property is to be owner-occupied or rented by the transferee; and

f) other information required by ADOT.

3.   Excludes, from the total sale payment amount, other consideration such as furniture and the value of amenities if such consideration constitutes more than five percent of the sale payment amount.

4.   Requires ADOT, on an applicant's request, to allow the applicant to provide on the certificate of title a post office box address that is regularly used by the applicant.

5.   Requires all transferees to sign the application and allows one transferee to sign the application if:

a)   the application is to convert an out-of-state certificate of title to an in-state certificate of title; and

b)   the ownership or legal status of the mobile home does not change.

6.   Requires an applicant to submit the following information with an application for a certificate of title to a new mobile home:

a)   either a manufacturer's certificate of origin showing the date of sale to the dealer or person first receiving the mobile home from the manufacturer or a factory invoice, a form that is provided by ADOT or other documentation that shows the date of sale to the dealer or the person who first received the mobile home from the manufacturer;

b)   the name of the dealer or person;

c)   a description sufficient to identify the mobile home;

d)   a statement certifying that the mobile home was new when sold; and

e)   if sold through a dealer, a statement by the dealer certifying that the mobile home was new when sold to the applicant.

7.   Requires manufacturer's certificate of origin to be surrendered to ADOT before a certificate of title to a new mobile home may be issued.

8.   Requires a person applying for a certificate of title to a used mobile home to submit either:

a)   an endorsed certificate of title; or

b)   an endorsed title transfer form.

9.   Requires ADOT to provide each county assessor with copies of or access to the information contained in an application.

10.  Makes conforming changes.

11.  Becomes effective on the general effective date.

Amendments Adopted by Committee

1.   Increases the timeframe, from 15 to 30 days, for a person to submit an application.

2.   Requires an applicant for the certificate of title of a used mobile home to submit an endorsed certificate of title or title transfer form.
