criminal justice data collection; system.

Purpose

Requires the Arizona Criminal Justice Commission (ACJC) to implement the State, County and Municipal Open Data System (Data System) on ACJC's website in a format that is readily accessible to the public. Appropriates $14,300,000 from the state General Fund (state GF) to ACJC from FY 2024 through FY 2026 to implement the Data System.

Background

The ACJC is designated as the central collection point for criminal justice data collection and may, unless prohibited by federal law, require any state or local criminal justice agencies to submit any necessary information that is currently collected and readily reportable by the agency at the time of the request. This information includes an agency's compliance with statutorily required reports or mandated federal or state reporting, or any other information that is deemed necessary by a vote of ACJC (A.R.S. § 41-2408).

S.B. 1588 appropriates $4,700,000 in FY 2024, $4,800,000 in FY 2025 and $4,800,000 in FY 2026 from the state GF to the ACJC to implement and maintain the Data System.

Provisions

1.   Requires ACJC to implement the Data System to be published on ACJC's website in a modern, open and electronic format that is readily available to the public.

2.   Requires ACJC, beginning January 1, 2024, and unless prohibited by any other law, to submit data into the system as prescribed.

3.   Appropriates monies from the state GF to ACJC to implement the Data System in the following amounts:

a)   $4,700,000 in FY 2024;

b)   $4,800,000 in FY 2025; and

c)   $4,800,000 in FY 2026.

4.   Requires law enforcement agencies to report specified identifying information for alleged offenders, victims and agencies or service providers, as well as other relevant data points for specific events and results.

5.   Requires prosecuting agencies to report specified identifying information for defendants, victims and agencies, as well as other relevant data points for specific events and results.

6.   Requires the courts to report specified identifying information for defendants and agencies, as well as other relevant data points for specific events and results.

7.   Requires the Arizona Department of Corrections, Rehabilitation and Reentry to report specified identifying information for inmates, agencies and provider or facilities, as well as other relevant data points for specific events or services and results.

8.   Requires probation departments to report specified identifying information for probationers, agencies and events, as well as other relevant data points for results.

9.   Prohibits ACJC from releasing any disaggregated personal identifying, locating information, photographs or mugshots of any person.

10.  Specifies that ACJC may require criminal justice agencies to submit any necessary information that is currently collected and readily reportable electronically by the agency at the time of the request.

11.  Exempts the appropriations from lapsing.

12.  Defines terms.

13.  Makes technical and conforming changes.

14.  Becomes effective on the general effective date.

Amendment Adopted by the Military Affairs, Public Safety and border Security Committee

1.   Prohibits ACJC from releasing any disaggregated personal identifying information, locating information, photographs or mugshots of any person.

2.   Modifies information that is required to be submitted to ACJC for the Data System.

Amendments Adopted by Committee of the Whole

1.   Removes certain information that must be reported to ACJC for the new Data System, including an alleged offender's or victim's birthplace, country of residence, tribal nation membership, veteran status, spoken languages and gender identity, as well as whether a specific event either restricted a person's right to purchase a firearm or required an interpreter.

2.   Makes technical changes.
