Purpose
Increases, from 90 to 130, the number of days after an election in which a special recall election may be called. Modifies the time frame that a candidate may circulate a nomination petition.
Background
A special recall election must be called 90 days prior to the next consolidated election day (A.R.S. § 19-209). The name of the officer who had a recall petition filed against them must be placed as a candidate on the official ballot without nomination. Other candidates for the office may be nominated to be voted on at the election and must be placed on the official recall ballot after filing a nomination petition that is signed by at least two percent of qualified electors. Signers of a nomination petition must be qualified electors of the electoral district of the officer against whom the recall petition is filed. The nomination petition must be filed between 90 and 60 days before the date of the recall election (A.R.S. § 19-212).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
2. Allows a candidate for the office to circulate a nomination petition for the time provided to circulate a recall petition.
3. Adjusts the time frame in which a candidate is required to file a nomination petition from between 60 days and 90 days before the recall election to between 90 days and 120 days before the recall election.
4. Makes technical changes.
5. Becomes effective on the general effective date.
