FACT SHEET FOR s.b. 1697

 

highways; bicycle paths; walkways; prohibition

Purpose

Prohibits the Arizona Department of Transportation (ADOT) from planning, designing or constructing bicycle paths or pedestrian walkways and accepting federal monies conditioned on the design and construction of a bicycle path or pedestrian walkway, as prescribed.

Background

ADOT is responsible for the design and construction of state public transportation systems and the maintenance and operation of state highways in Arizona (A.R.S. § 28-332). ADOT may: 1) accept and expend grants, donations, aid or other monies received from the federal government or any federal agency for any transportation purpose; and 2) contract and do all things necessary to secure the full benefits available to Arizona for transportation purposes under federal law. ADOT may exchange federal monies with local governments in order to receive local monies and may include additional federal monies in the exchange to offset the matching costs required of local governments (A.R.S. § 28-334).

               There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Prohibits ADOT from accepting federal monies for the construction, maintenance or expansion of a highway or state route if the acceptance of federal monies is conditioned on the design and construction of a bicycle path or pedestrian walkway as a component of the highway or state route.

2.   Prohibits ADOT from planning, designing or constructing bicycle paths or pedestrian walkways that are parallel to and separate from a highway or state route existing before, on or after the effective date of this legislation.

3.   Becomes effective on the general effective date.
