ARIZONA STATE SENATE

Gila River Indian Community plates.
Purpose
Establishes a Gila River Indian Community special plate, an Ak-Chin Indian Community special plate, a humanitarian service organization special plate and the Humanitarian Service Organization Special Plate Fund (Fund).
Background
The Arizona Department of Transportation (ADOT) Motor Vehicle Division provides one license plate to every motor vehicle owner for each vehicle registered (A.R.S. § 28-2351). ADOT is required to issue or renew special plates in lieu of regular license plates under specified conditions and procedures (A.R.S. § 28-2403). The fee for obtaining or renewing a special plate is $25 (A.R.S. § 28-2402). Of the $25 fee, $8 is an administration fee that ADOT deposits in the State Highway Fund (SHF) and $17 is a donation.
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
Gila River Indian Community Special Plate
1. Requires ADOT to issue a Gila River Indian Community special plate if, by December 31, 2023, a person pays the $32,000 implementation fee.
2. Requires the person that provides the implementation fee to design the Gila River Indian Community special plate, subject to ADOT approval.
3. Allows the Director of ADOT (Director) to combine a request for a Gila River Indian Community special plate with a request for a personalized special plate.
4. Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the Gila River Indian Community special plate and personalized special plate.
5. Specifies that, of the $25 fee required to obtain or renew a Gila River Indian Community special plate, $8 is an administration fee and $17 is an annual donation.
6. Requires ADOT to deposit all special plate administration fees in the SHF and transmit Gila River Indian Community special plate donations to the Gila River Indian Community Transportation Committee.
7. Requires the Gila River Indian Community Transportation Committee to use the monies only for traffic control devices, as prescribed by the Manual on Uniform Traffic Control Devices, on highways on the Gila River Indian Reservation in Arizona that are not state highways.
Ak-Chin Indian Community Special Plate
8. Requires ADOT to issue an Ak-Chin Indian Community special plate if, by December 31, 2023, a person pays the $32,000 implementation fee.

Humanitarian Service Organization Special Plate
15. Requires ADOT to issue a humanitarian service organization special plate if, by December 31, 2023, a person pays the $32,000 implementation fee to ADOT.
16. Requires the person that provides the implementation fee to design the humanitarian service organization special plate.
17. Subjects the design and color of the humanitarian service organization special plate to ADOT approval.
18. Allows the Director to combine a request for a humanitarian service organization special plate with a request for a personalized special plate.
19. Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the humanitarian service organization special plate and personalized special plate.
20. Specifies that, of the $25 fee required to obtain or renew a humanitarian service organization special plate, $8 is an administration fee and $17 is an annual donation.
21. Requires the first $32,000 in the Fund to be reimbursed to the person that paid the implementation fee.
22. Requires ADOT to deposit special plate administration fees in the SHF and humanitarian service organization special plate donations in the Fund.
23. Establishes the Fund consisting of humanitarian service organization special plate donations.
24. Specifies that no more than 10 percent of monies deposited in the Fund annually may be used for administering the Fund.
25. Requires, on notice from the Director, the State Treasurer to invest and divest Fund monies and to credit monies earned to the Fund.
26. Specifies that Fund monies are continuously appropriated.
27. Requires the Director to annually allocate Fund monies, excluding administrative fees, to a 501(c)(3) organization that:
a) has a global network of at least 1,200,000 persons who make a positive and lasting change in communities in and outside of the United States;
b) takes action on sustainable projects;
c) works to better the world and communities through projects relating to literacy, peace, water and health;
d) has been in Arizona since 1914;
e) has at least 114 clubs in Arizona and has more than 5,000 members in Arizona; and
f) has raised monies in Arizona to support service projects promoting peace, fighting disease, providing clean water, sanitation and hygiene, saving mothers and children, supporting education, growing local economies and protecting the environment.
Miscellaneous
28. Makes conforming changes.
29. Becomes effective on the general effective date.
Revisions
· Corrects the House of Representatives Transportation & Infrastructure Committee vote to reflect that H.B. 2062 received a do pass, as amended, recommendation.
