Purpose
Reduces, from $19,000,000 to $6,000,000, the FY 2023 appropriation for a design to widen lanes along State Route 347 (SR 347). Appropriates $10,300,000 from the State Highway Fund (SHF) in FY 2023 to the Arizona Department of Transportation (ADOT) to design and construct improvements to State Route 238 (SR 238) or SR 347, or both SR 238 and SR 347, excluding landscaping and improvements for nonvehicular travel.
Background
ADOT is responsible for the design and construction of state public transportation systems and the maintenance and operation of state highways in Arizona (A.R.S. § 28-332). ADOT may contract and do all things necessary to secure the full benefits available to Arizona for transportation purposes under federal law. ADOT may cooperate with: 1) federal, state and local government agencies; 2) Indian tribes; 3) private and public organizations; and 4) private individuals. ADOT may exchange federal monies with local governments in order to receive local monies and may include additional federal monies in the exchange to offset the matching costs required of local governments (A.R.S. § 28-334).
Laws 2022, Chapter 309 appropriates monies from the SHF in FY 2023 to ADOT for 26 highway projects, including a $19,000,000 appropriation for a design to widen lanes along SR 347 between Interstate 10 (I-10) and the City of Maricopa.
H.B. 2063 redirects $10,300,000 of the $19,000,000 FY 2023 appropriation from the SHF to ADOT to distribute to the City of Maricopa to design and construct improvements to SR 238 or SR 347, or both.
Provisions
1. Reduces, from $19,000,000 to $6,000,000, the FY 2023 appropriation from the SHF to ADOT for a design to widen lanes along SR 347 between the I-10 and City of Maricopa.
2. Appropriates $10,300,000 from the SHF in FY 2023 to ADOT to distribute to the City of Maricopa to design and construct improvements to SR 238 or SR 347, or both.
3. Prohibits the $10,300,000 appropriation from being used for landscaping or improvements for nonvehicular travel.
4. Exempts the $10,300,000 appropriation from:
a) review by the Joint Committee on Capital Review; and
b) lapsing until the appropriation's purpose has been accomplished or abandoned or the appropriation stands for a full fiscal year without an expenditure or encumbrance.
5. Becomes effective on signature of the Governor.
Amendments Adopted by the Appropriations Committee
1. Reduces the $13,000,000 appropriation to $10,300,000.
2. Prohibits the reduced appropriation from being used for landscaping or improvements for nonvehicular travel.
