state land transfer; Bullhead City
Purpose
Transfers approximately 9.95 acres of state sovereign land from the Arizona State Land Department (ASLD) to Bullhead City.
Background
The ASLD administers all laws relating to lands owned by, belonging to and under the control of the State of Arizona. The ASLD must have charge and control of all lands owned by the state of Arizona, and timber, stone, gravel and other products of such lands. (A.R.S. § 37-102).
Public trust land is the portion of the bed of a watercourse that
is located in Arizona and that is determined to have been a navigable
watercourse as of February 14, 1912 (A.R.S.
§ 37-1101). State land includes any land owned or held in
trust, or otherwise, by the state, including leased school or university land (A.R.S.
§ 37-101).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Transfers the title of approximately 9.95 acres of state sovereign land from the ASLD to Bullhead City.
2. Outlines the location of the state sovereign land.
3. Requires the State Land Commissioner to deliver a properly signed and recorded deed or patent to Bullhead City within 10 days after the general effective date.
4. Requires the outlined state sovereign land to be managed by Bullhead City for park and public recreation purposes perpetually.
5. Prohibits the outlined state sovereign land from sale, exchange or barter.
6. Becomes effective on the general effective date.
