Purpose

Limits the positions in which a school district may employ a person who served as a member of the school district's governing board during the preceding two years.

Background

An Arizona registered voter who has been a resident of a school district for at least one year is eligible for election to the school district's governing board. A school district employee, including a person who provides services as an employee of a third-party contractor, or the spouse of a school district employee may not serve on the employing school district governing board. A school district governing board may not employ a person who is a governing board member or a governing board member's spouse. A school district governing board member is ineligible to serve simultaneously on or be a candidate for nomination or election to another governing board, unless it is the last year of the governing board member's term (A.R.S. §§ 15-421 and 15-424).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Limits the positions in which a school district may employ a person who served as a member of the school district's governing board during the preceding two years to only positions in which the person will provide services directly to students, including as:

a)   a certificated teacher;

b)   a substitute teacher; and

c)   an employee or contractor who provides transportation, instructional support or student support services.

2.   Specifies that the limitation on employing a person who served on the school district's governing board includes employment through a third-party contractor that provides services to the school district.

3.   Allows a school district to increase the time period of the limitation to more than two years.

4.   Makes technical and conforming changes.

5.   Becomes effective on the general effective date.

                                                                                                                                                                          

Amendments Adopted by Committee of the Whole

1.   Narrows, to apply only to positions other than positions in which a person provides services directly to students, the prohibition on a school district employing a person who served on the school district governing board in the preceding two years.

2.   Makes conforming changes.
