Purpose
Allows a person, in lieu of prescribed education requirements, to qualify for an aesthetician, nail technology or hairstyling license by participating in a Department of Economic Security (DES)-approved or U.S. Department of Labor (U.S. DOL)-approved apprenticeship program that includes infection protection and law review instruction.
Background
The seven-member Barbering and Cosmetology Board (Board) enforces sanitary and safety requirements for salons and schools and for the practice of cosmetology, aesthetics, nail technology and hairstyling. The duties of the Board include issuing licenses, administering and grading practical and written examinations and prescribing the minimal school curriculum requirements for cosmetologists, aestheticians, nail technicians, hairstylists and school instructors (A.R.S. §§ 32-502 and 32-504).
To qualify for an aesthetician license, a person must either complete an aesthetician course consisting of at least 600 hours of training in a Board-licensed school or graduate from an aesthetician school in another state or country with substantially the same requirements as Arizona (A.R.S. § 32-510). To qualify for a nail technician license, a person must either complete a nail technician course consisting of at least 600 hours of training in a Board-licensed school or graduate from a nail technology school in another state or country with substantially the same requirements as Arizona (A.R.S. § 32-512). To qualify for a hairstylist license, a person must either complete a hairstylist course consisting of at least 1,000 hours of training in a Board-licensed school or graduate from a hairstyling school in another state or country with substantially the same requirements as Arizona (A.R.S. § 32-512.01).
Statute currently allows a person, in lieu of prescribed education requirements, to qualify for a cosmetology license by participating in a DES-approved or U.S. DOL-approved apprenticeship program in cosmetology that includes at least 250 hours of infection protection and law review instruction through either: 1) a Board-licensed school or a school or program in another state with substantially the same requirements as Arizona; or 2) a DES-approved apprenticeship program (A.R.S. § 32-511). A person participating in a DES-approved apprenticeship program in cosmetology is exempt from the applicability of cosmetology statutes while working with a mentor in a Board-licensed establishment (A.R.S. §32-506).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Entitles a person, in lieu of prescribed education requirements, to an aesthetician's license if the person completes a U.S. DOL-approved or DES-approved apprenticeship program in aesthetics that includes at least 200 hours of infection protection and law review instruction.
2. Entitles a person, in lieu of prescribed education requirements, to a nail technology license if the person completes a U.S. DOL-approved or DES-approved apprenticeship program in nail technology that includes at least 150 hours of infection protection and law review instruction.
3. Entitles a person, in lieu of prescribed education requirements, to a hairstyling license if the person completes a U.S. DOL-approved or DES-approved apprenticeship program in hairstyling that includes at least 200 hours of infection protection and law review instruction.
4. Requires a person to complete the prescribed infection protection and law review instruction through either:
a) a Board-licensed school or a school or program in another state with substantially the same requirements as Arizona; or
b) a DES-approved apprenticeship program.
5. Excludes a person participating in a DES-approved apprenticeship program in aesthetics, nail technology or hairstyling from the applicability of cosmetology statutes while working with a mentor in a Board-licensed establishment.
6. Makes technical and conforming changes.
7. Becomes effective on the general effective date.
