Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 49, chapter 2, article 3.2, Arizona Revised Statutes, is amended by adding section 49-256.03, to read:

START_STATUTE49-256.03. Dry washes; dredge and fill permits; exemption

Notwithstanding any other law, a dry wash, arroyo or other similar physical feature on private property that does not contain water is not a water of this state, is exempt from the permit program prescribed by this article and is not a water of the United States under the clean water act.END_STATUTE
