An Act

 

amending title 9, chapter 4, article 6, Arizona Revised Statutes, by adding section 9-461.18; relating to municipal planning.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 9, chapter 4, article 6, Arizona Revised Statutes, is amended by adding section 9-461.18, to read:

START_STATUTE9-461.18. Housing plan; report

A. A municipality with a population of more than seventy-five thousand persons shall develop a housing plan. The housing plan shall consider both of the following:

1. The legislature's requirement that municipalities facilitate an opportunity for a variety of housing that meets the needs of various income levels living, working or desiring to live in the municipality.

2. The ability of residents with various incomes to benefit from and fully participate in neighborhood and community life.

b. The housing plan shall include an analysis of how the municipality will provide an opportunity to develop workforce housing and moderate-income housing in the next five years.  The analysis shall include:

1. The municipality's current housing supply that serves as workforce housing.

2. The municipality's current housing supply that serves as moderate-income housing.

3. The municipality's total housing supply.

4. The municipality's current population and the estimated population growth over the next five years.

c. The housing plan shall include a recommendation to implement seven or more of the following strategies:

1. Rezoning for densities necessary to ensure the production of workforce housing and moderate-income housing.

2. Facilitating the rehabilitation of existing uninhabitable housing to workforce housing or moderate-income housing.

3. considering municipal general fund subsidies and other sources of revenue to waive CONSTRUCTION-related fees generally imposed by the municipality. 

4. creating, allowing for and reducing regulations related to accessory dwelling units in residentially zoned areas.

5. Allowing for higher density residential development or moderate-income residential development in commercial and mixed-use zoned areas, commercial centers or employment centers.

6. Encouraging higher density residential development, workforce residential development and moderate-income residential development near major transit investment corridors.

7. Eliminating or reducing parking requirements for residential developments where the resident is less likely to rely on the resident's own vehicle.

8. allowing for single-room occupancy developments.

9. Implementing zoning incentives for low-income to moderate-income housing units on a long-term basis. 

10. Preserving existing moderate-income housing.

11. Reducing impact fees related to low-income housing and moderate-income housing. 

12. Participating in a community land trust program for low-income housing or moderate-income housing.

13. Implementing a mortgage assistance program for employees of the municipality or an employer that provides services to the municipality on a contract basis. 

d. The governing body of the municipality shall annually do all of the following:

1. Review the housing plan and implementation of the housing plan.

2. Prepare a report on the findings of the annual housing plan review.

3. Post the report of the annual review of the housing plan on the municipality's website.

e. The report required pursuant to subsection d of this section shall include all of the following:

1. A revised estimate of the need for workforce housing and moderate-income housing in the municipality over the next five years. 

2. A description of the progress made IN the municipality to provide workforce housing and moderate-income housing.  The description shall include an analysis of the number of housing units in the municipality that are at or below the following:

(a) Eighty percent of the area median family income.

(b) Fifty percent of the area median family income.

(c) Thirty percent of the area median family income.

3. A description of efforts made by the municipality to use a moderate-income housing set-aside from a community reinvestment agency, redevelopment agency or community development and renewal agency.

4. A description of how the municipality has implemented the recommendations related to workforce housing and moderate-income housing described in subsection C of this section. END_STATUTE
