An Act
amending title 13, chapter 29, Arizona Revised Statutes, by adding section 13-2925; relating to offenses against public order.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 13, chapter 29, Arizona Revised Statutes, is amended by adding section 13-2925, to read:
13-2925. Unlawful use of public rights-of-way; classification
A. It is unlawful for a person to use a public street, highway, alley, lane, parkway, sidewalk or other right-of-way, whether the right-of-way is dedicated to the public in fee or by easement, for lying, sleeping or otherwise remaining in a sitting position UNLESS one of the following applies:
1. the person is experiencing a physical emergency.
2. The violation occurs in the course of administering medical assistance.
3. The right-of-way is subject to a permit to conduct a festival, fair, parade, concert, fireworks display or other similar event.
B. A person who violates this section is guilty of a class 1 misdemeanor.
