establishing a transportation funding pilot program; appropriating monies.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Transportation funding pilot program; delayed repeal

A. The department of education shall establish a transportation funding pilot program to provide per pupil weighted transportation funding to school districts that participate in the program.  The department shall establish policies and procedures for school districts to apply to participate in the program.

B. Notwithstanding any other law, during any year in which a school district participates in the transportation funding pilot program, the school district may not:

1. Include the transportation revenue control limit determined pursuant to section 15-946, Arizona Revised Statutes, in its revenue control limit.

2. Include the transportation support level determined pursuant to section 15-945, Arizona Revised Statutes, in its district support level.

C. The department of education shall develop support level weights for transportation costs that exceed basic per pupil funding.

D. This section is repealed from and after December 31, 2026.

Sec. 2. Appropriation; department of education; transportation funding pilot program; exemption

A. The sum of $50,000,000 is appropriated from the state general fund in fiscal year 2023-2024 to the department of education for the transportation funding pilot program established pursuant to this act.

B. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations, except that all monies remaining unencumbered or unexpended on June 30, 2026 revert to the state general fund.
