amending title 14, chapter 5, article 3, Arizona Revised Statutes, by adding section 14-5318; relating to guardianship.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 14, chapter 5, article 3, Arizona Revised Statutes, is amended by adding section 14-5318, to read:

START_STATUTE14-5318. Developmental disabilities; parents; automatic appointment

A. Notwithstanding sections 14-5301.03 and 41-5305, a parent who is the primary caregiver of a minor child who is receiving services pursuant to title 36, chapter 5.1 shall automatically and immediately become the guardian of that child on the child's eighteenth birthday.

b. if a parent who is the primary caregiver of a minor child who is receiving services pursuant to title 36, chapter 5.1 does not wish to automatically and immediately become the guardian of that child on the child's eighteenth birthday, the parent shall notify the department of economic SECURITY at least six months before the child's eighteenth birthday.   END_STATUTE
