An Act

 

amending title 28, chapter 3, article 10, Arizona Revised Statutes, by adding section 28-798; relating to pedestrians.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 28, chapter 3, article 10, Arizona Revised Statutes, is amended by adding section 28-798, to read:

START_STATUTE28-798. Congregating or soliciting on traffic island, median, highway ramp or unsafe location; prohibition; warning; civil traffic violation; violation; classification

A. A pedestrian may not congregate or engage in solicitation if the pedestrian is any of the following:

1. on a painted or raised traffic island or median.

2. on an exit or entrance ramp or roadway of a controlled access highway.

3. in an unsafe location where there is not a sidewalk or a safe corridor for pedestrians.

B. If a person violates this section:

1. For the first violation, a PEACE officer may not issue a citation and may issue only a warning.

2. For a second violation, the person is responsible for a civil traffic violation.

3. For a third or subsequent violation, the person is guilty of a class 1 misdemeanor. END_STATUTE
