A Concurrent Resolution
proposing an amendment to the Constitution of Arizona; amending article IX, Constitution of Arizona, by adding section 26; relating to taxation.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:
1. Article IX, Constitution of Arizona, is proposed to be amended by adding section 26 as follows if approved by the voters and on proclamation of the Governor:
26. Vehicle miles traveled; taxing, monitoring and limiting prohibited; exception
Section 26. a. This state and any county, city, town, municipal corporation or other political subdivision of this state shall not do either of the following:
1. impose a tax or fee on any person based on the vehicle miles traveled by the person in a motor vehicle.
2. enact any rule or law to monitor or limit the vehicle miles traveled by a person in a motor vehicle unless the rule or law REQUIRES that the person voluntarily consents to the monitoring or limitation.
b. this section does not apply to an interstate agreement that is established to administer the payment or reporting of fuel taxes or REGISTRATION fees for commercial vehicles that OPERATE in more than one state.
2. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
