An Act
amending title 23, chapter 2, article 1, Arizona Revised Statutes, by adding section 23-207; relating to employment.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 23, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 23-207, to read:
23-207. Breastfeeding mothers; teachers; public schools; reasonable accommodation; exemption
A. A school district or charter school may not prohibit a nursing mother who is a teacher at the school from bringing the mother's infant to the school in order to breastfeed the infant and shall provide a teacher with reasonable break times and a private place shielded from view to express breast milk. The school district or charter school must provide reasonable accommodations if the accommodations do not pose an undue hardship, including reasonable breaks and a private place to allow the nursing mother to breastfeed.
B. A school district or charter school is exempt from pROVIDING a reasonable accommodation if the school district or charter school can demonstrate an undue hardship that includes any of the following:
1. The costs associated with providing the reasonable accommodation.
2. The available resources of the school district or charter school.
3. A substantial alteration of an educational program.
4. A substantial classroom disruption or teacher workflow disruption.
5. A substantial safety concern or liability risk.
C. A school district or charter school is not required to provide child care services.
