Page 15, after line 25, insert:

"Sec. 4. Conditional enactment; notice; definition

A. This act does not become effective unless on or before September 1, 2027 both of the following occur:

1. The department of transportation establishes and funds a remediation program to help mitigate damage to land, including private property, that results from all-terrain vehicles.

2. The department of transportation establishes and funds a county sheriff law enforcement program relating to the all-terrain vehicle laws in this state to enable a county sheriff to have dedicated officers to enforce the all-terrain vehicle laws in this state.

B. The department of transportation shall notify the director of the Arizona legislative council in writing on or before October 1, 2027 either:

1. Of the date on which the condition was met.

2. That the condition was not met.

C. For the purposes of this section, "all-terrain vehicle" has the same meaning prescribed in section 28-101, Arizona Revised Statutes, as amended by this act."
