Page 1, line 21, after "of" insert "abandoned"

Line 42, before "the" insert "A."; strike "or installer"

Page 2, between lines 2 and 3, insert:

"b.  This section does not apply to an owner of a solar panel if either of the following apply:

1. The owner of the solar panel is either of the following:

(a) A public service corporation that is regulated by the corporation commission and:

(i) The corporation commission has issued a written decision or order that provides for or otherwise addresses the cost of decommissioning, disposing or recycling the solar panel at the end of the solar panel's useful life.

(ii) The public service corporation provides to the department evidence of the corporation commission's written decision or order.

(b) A public power entity that has service territory located in this state and:

(i) The governing body of the public power entity has at a duly noticed public meeting provided for or otherwise addressed the cost of decommissioning, disposing or recycling the solar panel at the end of the solar panel's useful life.

(ii) The public power entity provides to the department evidence of the governing body's written decision, minutes or vote.

2. The solar panel is installed pursuant to a contract or exclusive power purchase agreement with a public service corporation that is regulated by the corporation commission or a public power entity that has service territory located in this state and all of the following apply:

(a) The contract includes terms or provisions for:

(i) The decommissioning, disposal or recycling of the solar panel at the end of the solar panel's useful life.

(ii) One of the parties to secure a bond or otherwise provide financial assurance to cover the cost of decommissioning, disposing or recycling the solar panel at the end of the solar panel's useful life.

(b) The corporation commission or the governing body of the public power entity, as applicable, has approved the relevant terms or provisions of the contract required pursuant to subdivision a of this paragraph.

(c) The owner of the solar panel provides to the department evidence of the corporation commission's or governing body's approval, as applicable."
