SENATE AMENDMENTS TO H.B. 2060

Strike lines 13 and 14, insert:

"Sec. 3. Willcox groundwater basin; designation as subsequent irrigation non-expansion area; election

A. The Cochise county recorder and Graham county recorder shall include a question on the 2024 general election ballot for all eligible voters who reside and who receive their drinking water from within the Willcox groundwater basin regarding whether to designate the Willcox groundwater basin as an irrigation non-expansion area.

B. On the effective date of this act, the director of the department of water resources shall transmit to the Cochise county recorder and Graham county recorder a map of the Willcox groundwater basin.  The map shall be on a scale adequate to show with substantial accuracy where the boundaries of the Willcox groundwater basin or subbasin cross the boundaries of county voting precincts.

C. The director shall also transmit to the Cochise county recorder and Graham county recorder all other factual data concerning the boundaries of the Willcox groundwater basin that may aid the county recorder in determining which registered voters of the county are residents of the Willcox groundwater basin and are eligible voters, including a map of the residences that receive drinking water from the Willcox groundwater basin.

D. On receipt of the maps, the Cochise county recorder and Graham county recorder shall include on the 2024 general election ballot the following question for all eligible voters in the groundwater basin who receive their drinking water from the basin "Shall the Willcox groundwater basin be designated as an irrigation non-expansion area?" and appropriate boxes for the voter to check "yes" or "no". Only registered voters who reside within the Willcox groundwater basin and who receive their drinking water from the Willcox groundwater basin shall vote on the question.

E. After the general election results are certified, the director of the department of water resources shall make and file an order designating the Willcox groundwater basin as either:

1. The Willcox irrigation non-expansion area, if fifty percent or more of the eligible voters voted "yes".  The director shall file a true copy of the map of the Willcox irrigation non-expansion area in the office of the Cochise county recorder, Graham county recorder and the central and local offices of the department of water resources and shall provide a copy of the order and map to the chairpersons of the senate and house of representatives natural resources, energy and water committees, or their successor committees.

2. Outside the boundaries of any irrigation non-expansion area or active management area, if fewer than fifty percent of the eligible voters voted "yes".  The director shall file a true copy of the map of the Willcox groundwater basin in the office of the Cochise county recorder, the Graham county recorder and the central and local offices of the department of water resources and shall provide a copy of the order and map to the chairpersons of the senate and house of representatives natural resources, energy and water committees, or their successor committees.

Sec. 4. Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law."
