HB 2074: wildfire flooding mitigation fund; appropriation

Overview
Establishes the Wildfire Flooding Mitigation Grant Fund (Fund) and appropriates $35,000,000 from the Long-Term Water Augmentation Fund in FY 2025 to the Fund.
History
The Department of Emergency and Military Affairs (DEMA) was established, in order to administer the National Guard and is responsible for executing all orders relating to the militia, organizing, activating and allocating units, personnel, public relations and disciplining and training the National Guard and those members of the militia inducted into the service of Arizona (A.R.S. § 26-102).
The Long-Term Water Augmentation Fund is used for: 1) funding water supply development projects that import water from outside the boundaries of Arizona; 2) purchasing imported water or rights to imported water; 3) acquiring or constructing water-related facilities in Arizona to convey or deliver imported water within Arizona; and 4) providing financial assistance to eligible entities for financing or refinancing water supply development projects in Arizona (A.R.S. § 49-1303).
Provisions
1. Establishes the Fund to consist of legislative appropriations. (Sec. 1)
2. Designates DEMA to administer the Fund and allows DEMA to retain up to 1% of the monies in the Fund for administration costs. (Sec. 1)
3. Requires monies in the Fund to be provided to cities and towns to mitigate the effects of postfire flooding. (Sec. 1)
4. Exempts grants made in this section from the solicitation and award of grants requirements. (Sec. 1)
5. Designates a city or town as eligible to apply for and receive grant monies if:
a) the city or town has a population of less than 200,000 people;
b) the city or town offers a dollar-for-dollar match of the grant award that invests in stormwater flood mitigation, wastewater treatment infrastructure and wildlife suppression projects; and
c) the city's or town's matching monies are not sourced from federal monies and are approved by a majority vote of the registered voters. (Sec. 1)
6. Requires DEMA to prescribe a simplified form and procedure for cities and towns to apply for and DEMA to approve grants.
7. Requires each applicant for a grant in the Fund to:
a) certify eligibility;
b) describe the project and services for which the grant monies are requested and why the project and services are needed;
c) certify that all awarded grant monies will be used in compliance with the Fund; and
d) use any monies awarded only for postfire flood mitigation efforts. (Sec. 1)
8. Requires each grant awardee to submit a report of its use of awarded monies to the Chairpersons of the House of Representatives Natural Resources and Energy Committee and the Senate Natural Resources and Energy Committee on or before December 15th of each year. (Sec. 1)
9. Appropriates $35,000,000 from the Long-Term Water Augmentation Fund in FY 2025 to the Fund and exempts the appropriation from lapsing. (Sec. 2)
