Overview

Creates the Peace Officer Nonlethal Device Fund (Nonlethal Fund) and provides for its funding through court fees.

Pursuant to A.R.S. § 12-114, when a court permits an individual charged with a civil or criminal traffic offence to participate in a court-authorized diversion program, it is to collect a $9 surcharge on top of the fees charged by the diversion program (Diversion Surcharge). From the Diversion Surcharge, $5 are allocated to the Judicial Collection Enhancement Fund, and $4 are allocated to the Peace Officer Training Equipment Fund (Equipment Fund).

Provisions

1.   Reduces the allocation from the Diversion Surcharge to the Equipment Fund from $4 to $2. (Sec. 1)

2.   Allocates $2 from the Diversion Surcharge to the Nonlethal Fund. (Sec. 1)

3.   Establishes the Nonlethal Fund under the administration of the State Treasurer. (Sec. 2)

4.   Requires monies in the Nonlethal Fund to be used only for nonlethal devices for peace officers that do not cause permanent harm or injury. (Sec. 2)

5.   Instructs the State Treasurer to invest and divest Nonlethal Fund monies in accordance with existing state law. (Sec. 2)

6.   Specifies that monies earned from investment of Nonlethal Fund monies are to be credited to the Nonlethal Fund. (Sec. 2)

7.   Designates monies in the Nonlethal Fund as subject to legislative appropriation. (Sec. 2)

8.   Exempts Nonlethal Fund monies from lapsing. (Sec. 2)
