HB 2792: veterans' benefits; claims; prohibition; notice

Overview

Establishes rules for consultation on veterans' benefits matters, and instructs the Arizona Department of Veterans Services (ADVS) to post free United States Department of Veterans Affairs (VA) services on its website homepage.

History

ADVS provides services to veterans through various means including: 1) the administration of professional benefits counselors located throughout the state; 2) operating skilled-nursing veterans' home facilities to provide short-term and long-term care; and 3) operating veterans' memorial cemeteries (A.R.S. § 41-603).

Provisions

1.   ☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal NoteProhibits a person from receiving compensation directly from an individual for advising him about a veterans' benefits matter before ADVS or the VA, or referring him to another person to prepare, present or prosecute a claim or advise him on the same. (Sec. 1)

2.   Requires a person advising an individual about veterans' benefits matters to be accredited by the VA. (Sec. 1)

3.   Requires a person advising an individual to notify him of the free benefits claims filing services offered by ADVS and the VA prior to consulting. (Sec. 1)

4.   Instructs ADVS to post on a visible and prominent area of the home page of its website all free services the VA offers to individuals who want to file benefits claims. (Sec. 1)

5.   Stipulates that this Act does not prohibit a division of fees between attorneys that is otherwise proper. (Sec. 1)

6.   Defines veterans' benefits matter. (Sec. 1)
