 Summary of the Strike-Everything Amendment to SB 1237

Overview

Requires a filing officer to notify the Secretary of State when a candidate in their jurisdiction has an unsatisfied amount of $1,000 or more in fines resulting from a failure to comply with Arizona law on campaign contributions and expenses and requires that information to be publicly available on the Secretary of State's website.

History

A filing officer may not accept the nomination paper of a candidate for state or local office if the person is liable for a total of $1,000 or more in fines, penalties or late fees that have not been fully satisfied at the time of the attempted filing and the liability arose from a failure to comply with Arizona law on campaign contributions and expenses. In cases where the liability of these penalties is being appealed, the filing officer may accept a candidate's nomination paper (A.R.S. § 16-311).

2.   Stipulates that a person is ineligible to be a candidate for any elected office in this state, if the person has aggregated an unsatisfied amount of $1,000 or more in fines from a failure to comply with campaign contribution and expense requirements. (Sec. 1, 2, 3)

3.   Requires the Secretary of State to provide a website allowing filing officers to post information regarding candidates who have aggregated an unsatisfied amount of $1,000 or more in fines from a failure to comply with campaign contribution and expense requirements. (Sec. 4)

4.   States that the information on the website must identify the candidate, include the amount and date of the liability and be publicly available. (Sec. 4)
