Summary of the Strike-Everything Amendment to SB 1357

Overview

An emergency measure that authorizes family members and household members of eligible persons to prohibit the general public from accessing their records.

History

In any county, an eligible person may request that the general public be prohibited from accessing records relating to that person maintained by the county recorder, county assessor, county treasurer or the Arizona Department of Transportation (ADOT). Additionally, an eligible person, and any other registered voter who resides at the same residence address as the eligible person, may request that the general public be prohibited from assessing records relating to that person, including any of the person's documents and the voting precinct number contained in their voter registration record (A.R.S. §§ 11-483 and 16-153).

Provisions

1.   Authorizes family members and household members of eligible persons to request the county recorder, county assessor, county treasurer and ADOT to prohibit public access to their information. (Sec. 1, 2, 4, 8)

5.   Adds precinct, city or town and county to the information required on a nomination paper. (Sec. 5)

6.   Adds precinct, district or ward, city or town and county to the information required on a nomination paper for nonpartisan candidates. (Sec. 5)

7.   Adds district, precinct, city or town and county to the information required on a nomination paper for write-in candidates. (Sec. 6)

8.   Requires nomination petitions to include the candidate's precinct, city or town and county. (Sec. 7)

9.   Specifies that a law enforcement agency or employing state or local governmental entity is not required to disclose the personal information of a family member or household member. (Sec. 9)

10.  Includes the property that a public official owns or resides at in the information that, if knowingly released by a state or local government entity, constitutes a class 6 felony. (Sec. 10)

11.  Defines family member and household member. (Sec. 1, 2, 4, 8, 9, 10)

12.  Makes technical and conforming changes. (Sec. 1, 2, 4, 8, 9, 10)
