Overview

Requires the Department of Emergency and Military Affairs (DEMA) to prepare for a potential conflict in the Pacific by assessing certain state infrastructure and providing legislative recommendations for improving emergency response and risk mitigation strategies.

History

DEMA consists of the Arizona National Guard and the Division of Emergency Preparedness. Led by an adjutant general who acts as the director of the department, DEMA is responsible for executing the Governors orders relating to the Arizona National Guard and its organization, activation, recruiting, training, public relations and discipline. The adjutant general is also responsible for emergency management and all emergency activities except to those expressly reserved for the Governor. DEMA is annually required to submit a report to the Governor, the Senate President and the Speaker of the House that details the strength of the Arizona National Guard and the agency's business and financial activities (A.R.S. §§ 26-101, 26-102).

1.   Requires DEMA to identify, to the extent possible, any threats posed to the state of Arizona in the event of a Pacific conflict. (Sec. 1)

2.   Mandates that DEMA, to the extent possible, complete a comprehensive risk assessment that includes vulnerabilities and recommendations for emergency response strategies in the following areas:

(a)  critical infrastructure;

(b)  telecommunication infrastructure;

(c) military installations located within the state;

(d)  the state supply chain for critical procurements;

(e) the state vendor supply chain for critical procurements;

(f) state cybersecurity;

(g)  public health, safety and security in Arizona. (Sec. 1)

3.   Instructs DEMA to provide mitigation strategies and suggestions to limit or eliminate the risk posed to all the following in the event of a Pacific conflict:

(a)  critical infrastructure and other assets;

(b)  the safety and security of this state or nation. (Sec. 1)

4.   Requires DEMA to annually brief the Governor, the Senate President, the Speaker of the House of Representatives or their designees on or before December 31 of each year to address compliance with this section and provide legislative recommendations relating to risk assessment. (Sec. 1)

5.   Exempts this section from requirements of A.R.S. Title 38, chapter 3, article 3.1 (relating to public meetings and proceedings) and A.R.S. Title 39, chapter 1, article 2 (relating to searches and copies of public records). (Sec. 1)

6.   Requires Arizona state agencies to cooperate with DEMA for the purposes of this section. (Sec. 1)

7.   Repeals this section on January 1, 2029. (Sec. 1)

8.   Defines the following terms:

(a)  critical infrastructure;

(b)  Pacific conflict;

(c) state supply chain;

(d)  state vendor supply chain. (Sec. 1)

9.   Proclaims statements of Arizona state policy relating to this measure. (Sec. 1)

10.  Entitles this measure as the Pacific Conflict Stress Test Act. (Sec. 2)
