Summary of the Strike-Everything Amendment to SB 1654

Overview

Allows career technical education districts (CTEDs) to build housing facilities for foster youth and homeless, unaccompanied youth. Expands the uses of school districts' Litigation Recovery Fund to include maintenance and operation (M&O) and unrestricted capital outlay.

History

A CTED offers approved courses to students in grades 9 through 12 which require specialized instructors and equipment and which offer a defined pathway to a specific vocation or industry (A.R.S. § 15-391). The East Valley Institute of Technology, a CTED in Maricopa County, received a $10,000,000 appropriation in FY 2023 for the construction of a 64-bed transitional housing unit for foster youth through the CTED (Laws 2022, Chapter 313).

County Treasurers maintain a Litigation Recovery Fund for each school district, which receives monies from legal settlements. The school district may use Litigation Recovery Fund monies for reimbursements, paying bonded indebtedness to offset property taxes, improving school buildings and replacing school property (A.R.S. § 15-1107).

Provisions

1.   Permits a CTED to build, maintain and provide housing facilities and support services to students who are in foster care or are an unaccompanied youth. (Sec. 1)

2.   Allows a school district that receives monies from legal settlements to use the monies for remedial measures related to litigation. (Sec. 2)

3.   Authorizes a school district to use remaining monies in the district's Litigation Recovery Fund for M&O or unrestricted capital outlay. (Sec. 2)
