Summary of the Strike-Everything Amendment to SCR 1030
Overview
Subject to voter approval, allows the transfer of a marijuana establishment license if certain conditions are met and modifies the definition of violent crime.
History
Proposition 207 (2020) legalized marijuana for adult personal use. Proposition 207 also directed the Department of Health Services (DHS) to adopt rules governing social equity licenses and issue 26 marijuana establishment licenses under the Social Equity Ownership Program. These licenses were directed to individuals from communities disproportionately impacted by the enforcement of previous marijuana laws (A.R.S. § 36-2854).
A violent crime means any criminal act that results in death or physical injury or involves the criminal use of a deadly weapon (A.R.S. § 13-901.03).
Provisions
1. Prohibits DHS from issuing additional marijauna establishment licenses for the Social Equity Ownership Program. (Sec. 1)
2. Allows a marijuana establishment license to be transferred to any entity, if any of the following apply:
a) a principal officer or board member violated any marijuana-related rules when the license was originally issued;
b) a principal officer or board member failed to disclose an excluded felony offense; or
a principal officer or board member did not possess a card for a marijuana facility agent at the time of application. (Sec. 1)
3. Subjects the transfer of licenses to review and investigative determination by the Attorney General. (Sec. 1)
4. Applies the definition of violent crime regardless of whether the conviction is withheld due to a first offender, deferred adjudication or similar program. (Sec. 2)
5. Includes legislative intent. (Sec. 3)
6. Directs the Secretary of State to submit this measure to the voters as a proposition at the next general election.
