Purpose
Continues the Arizona State Board for Private Postsecondary Education
(AZPPSE) for
10 years.
Background
The AZPPSE licenses and regulates private postsecondary institutions that offer vocational and degree programs to Arizona students by reviewing license applications and renewals, investigating complaints and violations and taking disciplinary action when necessary. The AZPPSE administers the Student Tuition Recovery Fund to compensate students who suffer financial damages due to an institutional closure and retains student educational records from closed institutions for students to continue their education at another institution or provide educational verification to potential employers (A.R.S. §§ 32-3003 and 32-3071 – 32-3077).
The AZPPSE consists of seven Governor-appointed members who must hold specified positions that relate to private educational institutions and Arizona commerce or industry. Appointed members serve four-year terms unless removed by the Governor (A.R.S. § 32-3002).
The Senate Education Committee of Reference (COR) and House Education COR held a public meeting on December 6, 2023, to review the Auditor General's performance audit and sunset review, evaluate the AZPPSE's responses to the sunset review factors and receive public testimony. The CORs recommended that the Legislature continue the AZPPSE for 10 years, until July 1, 2034 (COR Report). The AZPPSE terminates on July 1, 2024, unless continued by the Legislature (A.R.S. § 41-3024.24).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Continues, retroactive to July 1, 2024, the AZPPSE for 10 years, until July 1, 2034.
2. Repeals the AZPPSE on January 1, 2035.
3. Contains a purpose statement.
4. Becomes effective on the general effective date, with a retroactive provision as noted.
