committees of reference; deadline; extension

Purpose

Extends, from the third Friday in January to the last day in January, the deadline for each committee of reference (COR) to hold at least one public hearing after receipt of the preliminary sunset review report and to deliver the final sunset review report of its recommendations as prescribed.

Background

During the sunset review process, each standing committee of both legislative houses must constitute a COR in the committee's respective subject matter areas. After receipt of the preliminary sunset review report, each COR or each COR meeting jointly must hold at least one public hearing when the Legislature is not in session or by the third Friday in January to receive testimony from the public and from the officials of the agency involved. Each COR must hold public hearings for the following purposes: 1) to determine the actual need of the agency to regulate or direct the particular activity; 2) to determine the extent to which the statutory requirements of the agency are necessary and are being met; 3) to receive testimony from the public as to the relationship of the agency with the public; and 4) to receive testimony from the executive director or other head of the agency as to reasons for the continuation of the agency. Each COR must deliver the final sunset review report of its recommendations to the President of the Senate, the Speaker of the House of Representatives, the Governor, the Auditor General and the affected agency by the third Friday in January (A.R.S. § 41-2954).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Extends, from the third Friday in January to the last day in January, the deadline for each COR to hold at least one public hearing after receipt of the preliminary sunset review report.

2.   Extends, from the third Friday in January to the last day in January, the deadline for each COR to deliver the final sunset review report of its recommendations as prescribed.

3.   Makes technical changes.

4.   Becomes effective on the general effective date.
