Purpose
Prohibits a political subdivision of Arizona from prohibiting a gun show from occurring in the political subdivision.
Background
A political subdivision of Arizona may not enact any rule or ordinance that relates to firearms and is more prohibitive than, or that has a penalty that is greater than, any state law penalty. A rule or ordinance that relates to firearms and that is inconsistent with or more restrictive than state law is null and void.
A political subdivision may not enact any ordinance, rule or tax relating to the transportation, possession, carrying, sale, transfer, purchase, acquisition, gift, devise, storage, licensing, registration, discharge or use of firearms or ammunition or any firearm or ammunition components or related accessories. A political subdivision also may not require the licensing or registration of firearms and ammunition or any firearm and ammunition components and related accessories or prohibiting the ownership, purchase, sale or transfer of firearms and ammunition or any firearm and ammunition components, or related accessories (A.R.S. § 13-3108).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Prohibits a political subdivision of Arizona from prohibiting a gun show from occurring in the political subdivision or enacting or enforcing any ordinance, rule or policy that primarily affects gun shows and effectively prohibits a gun show from occurring in the political subdivision.
2. Makes technical and conforming changes.
3. Becomes effective on the general effective date.
