dental hygienists; botox; continuing education

Purpose

Expands the scope of practice of dental hygienists to include the administering of high-quality injectable botulinum toxin type A (Botox) and dermal fillers to the oral maxillofacial complex for therapeutic or cosmetic purposes.

Background

A person is deemed a practicing dental hygienist if the person performs any of the operations or acts included in the general practice of dental hygienists, dental hygiene and all related and associated duties, including: 1) prophylaxis, scaling, closed subgingival curettage and root planing; 2) administering local anesthetics and nitrous oxide; 3) inspecting the oral cavity and surrounding structures for the purposes of gathering clinical data to facilitate a diagnosis;
4) periodontal screening or assessment; 5) recording clinical findings; 6) compiling case histories; 7) exposing and processing dental radiographs; and 8) all functions authorized and deemed appropriate for dental assistants. Dental hygienists are licensed and overseen by the Arizona State Board of Dental Examiners (BODEX) (A.R.S. § 32-1281).

Botox is a prescription medicine that is injected into muscles and used to treat various medical conditions including but not limited to incontinence, chronic headaches, severe underarm sweating and increased muscle stiffness. There is also a cosmetic version of the medication which is injected into the facial muscles to temporarily treat the appearance of fine lines and wrinkles in the skin (FDA).

Dermal fillers, also known as injectable implants, soft tissue fillers, lip and facial fillers or wrinkle fillers are medical device implants approved by the FDA for use in helping to create a smoother and/or fuller appearance in the face, including nasolabial folds, cheeks, chin, lips and back of the hands (FDA).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Expands the scope of practice of dental hygienists to include the administering of Botox and dermal fillers to the oral maxillofacial complex for therapeutic or cosmetic purposes.

2.   Allows dental hygienists, under the direct supervision of a licensed dentist, to administer Botox or dermal fillers upon successfully completing required continuing education.

3.   Allows dental hygienists, under the general supervision of a licensed dentist, to administer Botox or dermal fillers, if the hygienist has:

a)   for at least six months, administered Botox or dermal fillers under the direct supervision of a dentist; and

b)   successfully completed at least 75 injections within a two-year period under the direct supervision of a dentist.

4.   Requires dental hygienists administering Botox or dermal fillers to use high quality injectable products obtained from a reputable vendor.

5.   Requires BODEX, by July 1, 2025, to adopt rules establishing continuing education requirements for dentists and dental hygienists who administer Botox or dermal fillers to the oral maxillofacial complex for therapeutic or cosmetic purposes.

6.   Makes conforming changes.

7.   Becomes effective on the general effective date.

Amendments Adopted by Committee

1.   Removes the requirement that dental hygienists, under the direct or general supervision of a licensed dentist, be issued a neuromodulator or dermal certificate by BODEX to administer Botox or dermal fillers.

2.   Requires BODEX, by July 1, 2025, to adopt rules establishing continuing education requirements for dentists and dental hygienists who administer Botox or dermal fillers.
