Purpose

Allows a victim of domestic violence or a sexual offense or their attorney to request, at no charge, one copy of the police report and video recordings from the investigating law enforcement agency. Requires a law enforcement agency to prioritize the processing and providing of each police report that is requested as outlined.

Background

A victim of a criminal offense or of a delinquent act that is a part I crime under the Uniform Crime Reporting (UCR) Program, or the victim's attorney on behalf of the victim or an immediate family member of the victim, if the victim is killed or incapacitated, has the right to receive one copy of the police report and video recordings from the investigating law enforcement agency at no charge. On request of the victim, the court or the clerk of the court shall also provide, at no charge, the minute entry or portion of the record of any proceeding in the case that arises out of the offense committed against the victim and that is reasonably necessary for the purpose of pursuing a claimed victim's right (A.R.S. § 39-127).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1. Allows a victim of domestic violence or a sexual offense, or their attorney, to request:

a) one copy of the police report and video recordings from the investigating law enforcement agency at no charge; and

b) the minute entry or portion of the record of any proceeding in the case that arises out of the offense committed against the victim and that is reasonably necessary to pursue a claimed victim's right at no charge.

2. Requires a law enforcement agency to prioritize the processing and providing of each police report that is requested as outlined.

3. Defines sexual offense.

4. Makes technical changes.

5. Becomes effective on the general effective date.

Amendments Adopted by Committee

· Requires a law enforcement agency to prioritize the processing and providing of each police report that is requested in outlined circumstances rather than requiring a law enforcement agency provide one copy of the police report and video recordings within 14 days after a request is made.
