Purpose
Allows the Arizona Corporation Commission (ACC) to accept electronic applications for a Certificate of Environmental Compatibility (CEC).
Background
Every utility in Arizona that plans to construct a plant or transmission, or both, must first file with the ACC an application for a CEC. The application must be accompanied by information with respect to the proposed type of facilities and description of the site, including the areas of jurisdiction affected and the estimated cost of the proposed facilities and site. The application must also be accompanied by a receipt that evidences payment of the appropriate fee required of the application. Following submittal, the ACC must promptly refer the application and accompanying information to the chairman of the Power Plant and Transmission Line Siting Committee (Committee) (A.R.S. § 40-360.03).
25 copies of each application must be filed with the Director of Utilities of the ACC, plus additional copies as may be subsequently requested. The application must be delivered by the Director of Utilities to the Chairman of the Committee within 5 days after the date of filing and must be mailed to each member of the Committee within 10 days of the date of filing (A.A.C. Title 14, Chapter 3).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Allows the ACC to accept, from any utility that plans to construct a plant or transmission line, or both, applications for a CEC and accompanying information in an electronic format.
2. Allows the ACC to adopt rules to accept electronic filings and to ensure that proper notice is provided electronically to interested parties.
3. Makes technical changes.
4. Becomes effective on the general effective date.
