Purpose
Preempts a local authority from prohibiting cruising and from limiting a motor vehicle's suspension or bumper height.
Background
A local authority may not enact or enforce an ordinance or regulation in conflict with state law, unless expressly authorized by statute. A local authority may adopt additional traffic regulations that are not in conflict with state law and must adopt ordinances or regulations relating to the control and movement of traffic, including parking or standing ordinances or regulations that impose civil penalties for a violation of the ordinances or regulations. Unless a local ordinance or regulation imposes a criminal penalty, a violation of the ordinance or regulation constitutes a civil traffic violation (A.R.S. § 28-626).
A local authority is any county, municipal or other local board or body exercising jurisdiction over highways under the Arizona Constitution and laws of the state (A.R.S. § 28-101).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Prohibits a local authority from:
a) enacting or enforcing an ordinance or regulation that prohibits cruising; and
b) limiting motor vehicle suspension modifications or bumper heights.
2. Defines cruising as the repetitive driving of a motor vehicle past the same place without a destination or particular purpose within a specified time period.
3. Makes technical and conforming changes.
4. Becomes effective on the general effective date.
