voter registrations; recorder; inactive status

Purpose

Allows a county recorder to place a registrant's voter registration in inactive status upon receipt of information that the registration is fraudulent or contains incorrect information.

Background

If a county recorder receives information indicating a change to an elector's address, the county recorder must send a notice to the elector at the address that appears in the general county register or to the forwarding address provided by the U.S. Postal Service. The notice must include an internet address that the elector may use to revise the voter registration or a voter registration form and a statement that if the elector does not complete and return a new registration form with the elector's current information or update the registration online within 35 days, the elector's registration status will be changed to inactive.

County recorders maintain an inactive voter list with the names of electors who are removed from the general register for failure to update the elector's voter registration information within two general election cycles. The inactive voter list is maintained for four years or through the date of the second general election with a federal office following the date of the notice from the county recorder. The county recorder must cancel the registration of a voter on the inactive voter list if the elector does not vote in an election during the period commencing the date of the notice for two general election cycles (A.R.S. §§ 16-165 and 16-166).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Allows a county recorder to place a voter registration in inactive status and to provide notice to the registrant if the county recorder receives information that provides reasonable cause to believe that the registrant has fraudulently registered to vote or that the voter registration information provided is inaccurate. 

2.   Becomes effective on the general effective date.
