FACT SHEET FOR H.B. 2716

 

Arizona criminal justice commission; members

Purpose

Increases the number of members who are appointed to the Arizona Criminal Justice Commission (ACJC) from 14 to 16 with the two additional members consisting of one public defender and one victim advocate.

Background

The ACJC is established consisting of the following members: 1) the Attorney General or their designee; 2) the Director of the Department of Public Safety or their designee; 3) the Director of the Arizona Department of Corrections, Rehabilitation and Reentry or their designee; 4) 14 members, or their designees, who are appointed by the Governor, of which no more than 7 of these members may be from the same political party; 5) the Administrative Director of the courts or their designee; and 6) the chairman of the Board of Executive Clemency or their designee.

The members who are appointed to the ACJC must include at least: 1) one police chief, one county attorney and one county sheriff from a county with a population of 1.5 million persons or more; 2) one police chief, one county attorney and one county sheriff from a county with a population equal to or greater than 800 thousand persons but fewer than 1.5 million persons; and 3) one police chief, one county attorney and one county sheriff from counties with a population of fewer than 800 thousand persons. The remaining members must include one law enforcement leader, one former judge, one mayor, one member of a county Board of Supervisors and one chief probation officer (A.R.S. § 41-2404).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Increases, from 14 to 16, the number of members who are appointed to the ACJC by the Governor.

2.   Specifies that the two additional members appointed to the ACJC must consist of one public defender and one victim advocate.

3.   Increases, from 7 to 8, the number of members on the ACJC who may be from the same political party. 

4.   Makes technical changes.

5.   Becomes effective on the general effective date.
