emergency management assistance; reimbursement

Purpose

Allows the Emergency Management Assistance Compact and Arizona Mutual Aid Compact Revolving Fund (Fund) to consist of monies received as reimbursement for costs incurred by the State of Arizona and any supporting partners of the state while rendering aid in response to Arizona Mutual Aid compact requests that are coordinated and approved by the Division of Emergency Management. Allows monies in the Fund to also be used to reimburse supporting partners of the state and state agencies that respond to Arizona Mutual Aid Compact requests.

Background

The Fund consists of monies appropriated by the Legislature and monies received as reimbursement for costs incurred by the State of Arizona while rendering aid to provide for mutual assistance between states in managing any emergency or disaster that is duly declared by the Governor of the affected state, whether arising from natural disaster, technological hazard,
man-made disaster, civil emergency aspects of resources shortages, community disorders, insurgency or enemy attack. Monies in the Fund are used for costs incurred by the State of Arizona while assisting other states with outlined emergencies or natural disasters (A.R.S. §§ 26-402 and 26-403).

The federal Emergency Management Assistance Compact (EMAC) is a national interstate mutual aid agreement that enables states to share resources during times of disaster. EMAC acts as a complement to the federal disaster response system, providing relief to states requesting assistance from assisting member states. EMAC can be used either in lieu of federal assistance or in conjunction with federal assistance (FEMA).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Allows the Fund to consist of monies received as reimbursement for costs incurred by the State of Arizona and any supporting partners of the state while rendering aid in response to the Arizona Mutual Aid Compact requests that are coordinated and approved by the Division of Emergency Management.

2.   Allows monies in the Fund to also be used to reimburse supporting partners of the State of Arizona and state agencies that respond to Arizona Mutual Aid Compact requests that are coordinated by the Division of Emergency Management.

3.   Renames the Fund as the Emergency Management Assistance Compact and Arizona Mutual Aid Compact Revolving Fund.

4.   Defines Arizona Mutual Aid Compact as the compact made and entered into by and between participating member states that provides for mutual assistance between states as outlined in managing any emergency or disaster that is duly declared by the Governor of the affected state.

5.   Defines division as the Division of Emergency Management within the Department of Emergency and Military Affairs.

6.   Defines supporting partner as any county, city, town, private water or wastewater utility, special taxing district or federally recognized Indian Tribe that has fully executed Arizona Mutual Aid compact agreement.

7.   Becomes effective on the general effective date.

Amendments Adopted by Committee of the Whole

ˇ Modifies the definition of supporting partner to include a federally recognized Indian Tribe that has a fully executed Arizona Mutual Aid Compact agreement.
