An Act
amending title 15, chapter 1, article 1, Arizona Revised Statutes, by adding section 15-120.05; amending title 15, chapter 2, article 2, Arizona Revised Statutes, by adding section 15-249.08; relating to public schools.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 15-120.05, to read:
15-120.05. United States department of education office for civil rights; compliance reports; posting; redaction
A. Subject to subsection B of this section, each public school and each local education agency shall post on its website the most recent information that the public school or local education agency reported to the United States department of education office for civil rights for the purposes of the civil rights data collection survey.
B. This section does not authorize a public school or local education agency to publish data that is protected under the family educational rights and privacy act of 1974 (P.L. 93-380; 88 Stat. 57). A public school or local education agency that posts information on its website pursuant to subsection A of this section shall redact the information to ensure that it complies with this subsection.
Sec. 2. Title 15, chapter 2, article 2, Arizona Revised Statutes, is amended by adding section 15-249.08, to read:
15-249.08. School safety report; survey; posting
A. On or before December 15 of each year, the department of education shall submit a school safety report to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of the report to the secretary of state. The report shall contain the number of the following incidents reported at each school site in this state:
1. Bullying.
2. Fighting.
3. Sexual assault.
4. Threatening.
5. Intimidation.
6. Harassment.
7. Suicide.
8. Hazing.
9. Any form of physical attack that is not covered by paragraphs 1 through 8 of this subsection.
B. The department shall establish a survey to gather information for the report from each school district and charter school. A school district or charter school may not report personally identifiable student data.
C. The report shall be posted on the department's website in a format that is accessible to the public.
