An Act
amending title 33, chapter 23, article 1, Arizona Revised Statutes, by adding section 33-2502; relating to private property rights.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 33, chapter 23, article 1, Arizona Revised Statutes, is amended by adding section 33-2502, to read:
33-2502. Wind farms; location; consent; definition
A. Notwithstanding any other law, a wind farm may not be located within six miles of the outer perimeter of a property that is owned by a different person or entity than the person or entity that owns the property on which the wind farm is to be located, except if the property owner consents to the location of the wind farm in writing.
B. For the purposes of this section, "wind farm":
1. Means wind turbines and associated facilities that have a single interconnection to the electrical grid and that are designed for or capable of operation at an aggregate capacity of five or more megawatts.
2. Does not include one or more wind turbines and associated facilities that are primarily dedicated to providing electricity to a single customer at a single location and that are designed for or capable of operation at an aggregate capacity of less than twenty megawatts, as measured at the customer's point of interconnection to the electrical grid.
