An Act
amending title 15, chapter 5, article 1, Arizona Revised Statutes, by adding section 15-509; relating to school employees.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 15, chapter 5, article 1, Arizona Revised Statutes, is amended by adding section 15-509, to read:
15-509. School employees; applicants; criminal conviction disclosures; violation; classification; definition
A. Any individual who applies for employment by a school in this state shall disclose to each prospective employer whether the individual has pled guilty, pled no contest or been convicted of any of the following:
1. A dangerous crime against children pursuant to section 13-705.
2. A violation of section 13-1404 or 13-1406 in which the victim was a minor.
3. An act committed in another state or territory that if committed in this state would have been subject to disclosure pursuant to paragraph 1 or 2 of this subsection.
4. Sexual conduct with a minor pursuant to section 13-1405.
5. Any crime that requires the person to register as a sex offender pursuant to section 13-3821.
6. A preparatory offense as prescribed in section 13-1001 of any offense that is subject to disclosure pursuant to paragraph 1, 2, 3, 4 or 5 of this subsection.
B. Any individual who knowingly violates subsection A of this section is guilty of a class 3 misdemeanor.
C. For the purposes of this section, "school" means a school district, charter school or private school that provides instruction to students in kindergarten programs or any of grades one through twelve.
