AN ACT

 

amending section 5-326, Arizona Revised Statutes; relating to watercraft.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Section 5-326, Arizona Revised Statutes, is amended to read:

START_STATUTE5-326. Nonresidents; registration; payment of fees; exemption

A. A nonresident owner of a watercraft who establishes this state as the state of principal operation shall register and number that state [as the state of principal operation] shall register and number that watercraft pursuant to this article and pay an additional boating safety infrastructure fee assessed pursuant to section 5-327 before placing that watercraft on the waterways of this state.

B. A member of the armed forces of the United States who is on active duty and stationed in this state for a period of at least thirty days immediately before applying for watercraft registration is exempt from this section.

C. The NONRESIDENT owner shall carry and display proof of payment of the fee required by this section in a manner prescribed by the commission while the watercraft is underway, moored or anchored on the waterways of this state.

d. a nonresident owner shall provide proof of insurance in this state.

e. regardless of Whether a nonresident owner of a watercraft establishes this state as the state of principal operation of a watercraft, if the NONRESIDENT owner intends to enter into rental agreements with a third party for the rental of a watercraft in this state, the nonresident owner shall do both of the following:

1. register and number the watercraft that the nonresident owner intends to rent to a third party pursuant to this article.

2. MAINTAIN and provide proof of insurance for the watercraft that is the subject of the third-party rental that is valid for the duration of state as the state of principal operation of a watercraft, if the NONRESIDENT owner intends to enter into rental agreements with a third party for the rental of that watercraft, the nonresident owner shall do all of the following:

1. register and number the watercraft that the nonresident owner intends to rent to a third party pursuant to this article.

2. pay an additional boating safety infrastructure fee assessed pursuant to section 5-327 before making the watercraft available for rent by a third party.

3. Carry and display proof of payment of the fee required pursuant to subsection c of this section.

4. MAINTAIN and provide proof of insurance for the watercraft that is the subject of the third-party rental that is valid for the duration of the watercraft rental.

D. f. Subsection A of this section does not apply to nonrecreational or commercial motorized watercraft. END_STATUTE
